You are responsible for your conduct, Content, and communications with others while using the service. You must comply with the following requirements when using the service:
(a) You may not misuse our service by interfering with normal operation, or attempting to access the service using a method other than through the interfaces and instruction that we provide.
(b) You may not circumvent or attempt to circumvent any limitations that the service imposes on your account.
(c)
To the extent permitted by applicable law, the aggregate liability of each of ixmage, its affiliates, officers, employees, agents, suppliers, and licensors arisings out of or in the connection with the services and these terms will not exceed the lesser of: (a) the amounts paid by you to ixmage for use of the service at issue during the 3 months prior to the event giving rise to the liability; and (b) US$100.00.
The subscription is charged monthly. When you subscribe, PayPal will manage the subscription details. Your billing cycle will be the day of the month you start the subscription. PayPal notifies ixmage every time they process a successful or failed payment.
When cancelling early, PayPal notifies us of the cancellation, but the current monthly cycle will finish on the expected date. After that date, your service tier is handled as the Free Tier.
Tier upgrades during a running cycle are yet to be handled gracefully. Please cancel the current subscription and then subscribe for the new desired tier.
You can terminate your subscription at any time through your control panel or your Paypal dashboard. PayPal will notify us and your current billing cycle will end at the normal expected time. After that date, any activity on your account will be for the Free Tier and applicable limits will take effect.
We may terminate your subscription at any point for any of the following reasons:
The service is owned and operated by ixmage. The visual interfaces, graphics, design, compilation, information, data, computer code (including source code or object code), products, software, services, templates, and all other elements of the service (“Materials”) provided by ixmage are protected by intellectual property of ixmage or its third party licensors. Except as expressly authorized by ixmage, you may not make use of the Materials. ixmage reserves all rights to the Materials not granted expressly in these Terms.
ixmage may change these Terms at any time for a variety of reasons, such as to reflect changes in applicable law or updates to services, and to account for new services or functionality. The most current version will always be posted on the ixmage website. If an amendment is material, as determined in ixmage’s sole discretion, ixmage will notify you by email. Notice of amendments may also be posted to ixmage’s blog or upon your login to your account. Changes will be effective no sooner than the day they are publicly posted. In order for certain changes to become effective, applicable law may require ixmage to obtain your consent to such change, or to provide you with sufficient advance notice of them. If you do not want to agree to any changes made to the terms for a service, you should stop using that service, because by continuing to use the service you indicate your agreement to be bound by the updated terms.
ixmage constantly changes and improves the services. ixmage may add, alter, or remove functionality from a service at any time without prior notice. ixmage may also limit, suspend, or discontinue a service at its discretion.
You agree not to use in any way the ixmage name or any ixmage trademarks, including our logos, domain names, or other brand features, without our prior permission.
Our service allows you and other users to process image content and make it available over the internet. You are responsible for the content that you make available to the service, including its legality, reliability, and appropriateness.
User Content is images (and files in general) that you use through the service. You retain any copyright and other proprietary rights that you may hold in the User Content that you post to the service. Nevertheless, we need certain permission from you in order to provide the service.
You may not post, link and otherwise make available on or through the service, any of the following:
Content that is libelous, defamatory, bigoted, fraudulent, or deceptive; Content that is illegal or unlawful, that would otherwise create liability; Content that may infringe or violate any patent, trademark, trade secret, copyright, right of privacy, right of publicity, or other intellectual or other right of any party. Private information of any third party (e.g., addresses, phone numbers, email addresses, social security numbers, and credit card numbers); and viruses, corrupted data or other harmful, disruptive, or destructive files or code.
By providing User Content (images) to or via the service, you grant ixmage a worldwide, non-exclusive, royalty-free, fully paid right and license (with the right to sublicense) to use, store, host, transfer, analyze, display, reproduce, modify for the purpose of the service, create derivatives and distribute your User Content, in whole or in part, in any media formats and through any media channels now known or hereafter developed. This license is solely for the purpose of providing our services to you.
These Terms will be governed by [State of Illinois] law except for its conflicts of laws principles. However, some contries (including those in the European Union) have laws that require agreements to be governed by the local laws of the consumer’s contry. This paragraph doesn’t override those laws.
